time limit for notice u/s 221

25 December 2009 Hello...

Pls guide me on this...

Notice of demand u/s 156 was issued on me on 1 year ago..

i didnt pay the tax nor i requested for stay...

BUT I PREFER APPEAL AGAINST THAT ORDER

but after a year when appeal proceeding is going on...

i got the notice u/s 221(1) for paying the amount and show cause why penalty not to be levied on 9.12.2009....

now i want to know IS DEPT CORRECT ???

is there any time limit for issue of notice u/s 221 ??

pls consider as URGENT.......
