Termination of articleship

29 May 2013 Hello Sir,

I joined articleship and completed only 2 months of training. He is quite harsh and scolding always and hence I told that I want termination. He asked me to bring form 109. But now telling like he is going to complaint about me to institute and make me not to appear final exam or create a black mark against me. Whether he is eligible to do that

What mistake you have done?

Why he will scold unnecessary?

transfer from articleship with in 1 year of articleship is allowed with out any restrictions.and no icai prior approval required

However you can take transfer from articleship only after completion of 6 months of articleship no request to take transfer with in 6 months of articleship is allowed

so work with him atleast 6 months and later you can take 109 and can leave from him.

29 May 2013 if I submit form 109 to ICAI also I should wait for 4 months to join another firm is it sir?

29 May 2013 I didnt do any kind of mistake.. he excepts me to do every work like expert & asks me to update tally work. i told him that I donno tally in the beggining itself.. he is a kind of rude so that 5 ppl took termination in last few months

As per ICAI rules

No request for termination of articles is entertained from any articled assistant in general and more particularly during the first six months and also during the last twelve months of articles except as provided in the Regulations.

So better you post a query to icai e-sahayata that you want to take transfer from current employer and i have completed 3 months articleship lets see how they respond,

as per my knowledge transfer not allowed atleast not completing 6 months as in above rule
