Termination and again new registration of form 102

21 May 2013 Hi Sir,
I passed IPCC group 1 in November 2012 and writting group 2 this May 2013. Due to unavoidable reason I could not able to continue in the existing firm with a duration of only 2 months. even if I dont wish to carry over my articleship period is that mandatory to give details of partial article experience in the new form 102 with another Auditor? pls guide me.

21 May 2013 if you have already submitted your 103 form to icai under old employer you are not permtted to transfer with in 6 months of articleship,

however it is permitted after completion of 6 months and with in 1 year with out any restriction

21 May 2013 I already submitted form 102,103 under old employer to the institute and received the id card. nw am i not eligible for termination?

21 May 2013 102 is not required to submit to ICAI

and coming to the point,
Yes if you have already submitted your form 103 you should complete at least 6 months of articleship period with old employer

21 May 2013 I decided to come out of the firm and if I submit form 109 to the Institute what will happen? Pls suggest me what to do next except contin. in the current firm.

21 May 2013 institute may not consider your request for transfer,

as per rule 8 notification provided in above rule

you may confirm the same with icai through e-sahayata if you want

21 May 2013 if institute does'nt recognise my termination and I dont continue to work under current employer what will happen Sir?

21 May 2013 you will remain as an article assitant with the first employer and leave will be counted from the date from which you are absent in work

21 May 2013 and I cannot join another firm without acception of form 109 from institute. right sir?

21 May 2013 you can join the next day provided you have to take transfer articleship after 6months but with in 1 year,

no need to wait till icai confirms your termination, icai will not object if your old principal accepts

you can send 109 , old employer id card, and 103 under new employer directly to icai for re-registration of articles
