if tds is deducted but not deposited can assessee file TDs statement in form 27Q . As interest is chrged on assessee for non -filing of tds statement .. when he has not deposited tax how he will file statement??

I think that TDS must deposit before filing TDS return.

Tds is not your income. You need to deposit it. Penal provisions would be applicable in case of default.
