24 April 2008 Can the TDS return be filed if the TDS has not been actually deposited for the specified qtr?

24 April 2008 wheter you are deduct tax or not it is important if you are deduct tax and not paid first you pay the same then file the tds return and if no tds is deducted then you file nill return

24 April 2008 but hemant, here i wish to know that suppose i deducted tds for qtr april to june and not deposited the same till 15th July, how will i file my tds return for qtr april to june for which last date of return filing is 15th july/

24 April 2008 It's ur fault that U has not deposited TDS.You have to pay Intt. on that TDS amount @ 1%Per Month or Part of the month.
And further if u not deposit ur TDS and TDS return within the due date of depositing the Return u have to pay Penalty for Rs. 100/-per day for not filing the Quarterly TDS return even when u hav not submitted the TDS amount.

24 April 2008 Submit the TDS return after depositing the TDS liability along with interest. But you need to file the return, also note after asst. by the TDS commi. you have to pay the penalty for delay in submission of TDS return.

25 April 2008 Mr. Anil and Mr. Chetan, plz consider i have no money to deposit tds amt now bt i just wans to escape penalty for late filing of tds return, so can i file tds return before due date without depositing amt of tds deducted ?
