17 September 2009 Dear Sir,

i has two times one party TDS Paid and Quartly return Submitted. and after check my data i had mistakly tds paid two times

pl reply what is processer for claim or return my amount ?

17 September 2009 issue the party a crdit invoice of the same amount with tax componant. it will ghet the credit in subsequent month.

17 September 2009 How it can be adjusted if there is no liability of TDS in the same section in subsequent months .

Is there any provision of getting refund of excess TDS deposited to Govt

17 September 2009 i dont think there is any provision under the act , to setoff excess TDS paid , the query remains open , experts requested to advise on any such provision . is there a possibility to treat that excess TDS as advance income tax ?

20 September 2009 The amount can be adjusted with liability arising under any other section. You may check the possibility.

In such an eventuality, you need to apply to the AO(TDS) to carry out necessary rectification in the section code.
