19 October 2012 Respected Experts,
We are making payment to a non resident company of U.K. for technical services provided by its employee to us. we are not paying the salary to the employee but directly to company as technical fees.Now my question is this that what will be the TDS rate.The said company has sent a consultant in India.Is there is a compulsory requirement of deducting TDS as the services are utilised in India? We also checked out the relevent treaty between U.K. & India which says that Its taxable @ 15%.So finally I want to know the final TDS Rate as we are to provide Form 15CA/CB to our client. Please reply soon. Its urgent.

19 October 2012 yes, TDS (Withholding Tax)will be deducted @ 10%.

For better understanding you can read section 195(h), which deals in 'Fee for technical services' to a non resident.
