TDS on warranty charges paid to outside india

22 April 2009 If we have to pay warrnty charges on sofrware companies to Canada, who does not have P.E. in India. Whether TDS is applicable. If applicable, whether we should deduct the TDS amount U/S. 195 or Warranty charges are covered under technical charges so as to cover under DTA with Canada.
