Please clarify wheather TDS is applicable for softwear purchase, if party is imposing service tax for the same and please give the Sec name

You are purchasing software. It falls under goods and hence VAT tax would be there. Since it is a sale transaction, no TDS provision would be attracted.
On the same ground no service tax also.
