Tds on salary & salary exp.......

30 December 2014 my client doesn't pay TDS on director & staff salary up to the filing of return for FY 13-14,so whether the salary expanse or TDS
amount is disallowed or not plz help in the situation,PLZ Provide section reference................

It will be disallowed. Please refer section 40(a)(ia)

It says if the Tds is not deducted or deducted but not paid on or before the due date specified in subsection (1)of sec-139.

31 December 2014 No Salary expense is not disallowed as section 40(a)(ia) does not cover the salary upto A.Y 2014-15.But from A.Y 2015-16 it would be disallowed upto 30%.
