TDS on salary

30 December 2010 Hi Everyone

I have a 2 queries, pls. help me solve it.

1) One of our employee had joined in the month of April and in the beginning of August she left. she was pd. salary of 1,06,972/-(Rs.31,250/- p.m ) for four months, after which she left without informing. The company has not deducted any TDS from her salary as mostly the tax calculation starts from Dec. Is the company liable for any tax payment.

30 December 2010 Ideally the company should have calculated the total expected salary from April onwards and should deducted TDS as well...

However if you did not deducted any tds till date....then as per my opinion the total salary paid during the period is below the basic exemption limit and not liable for any TDS therefore you are not required to deduct TDS..

While giving form 16 to employee just ensure if he declares the income from salary to next employer...who has to include this salary for the computation of Tax at their hand.
