Tds on detention chgs ?

28 December 2011 Dear Sir,
Transporter has raised a bill which also include detention chgs.(Eg. for detaining vehicle due to any reason like it took 5-6 days to get empty).
1)Is TDS applicable on such detention charges ? (As TDS is applicable on loading/unloading charges.
Pls quote the sec. & Rate if applicable, if possible wording used in the sec.
Pls note transport company is quoting his PAN No. in bills.

30 December 2011 You need not to deduct the tds if Pan No. is provided by the transporter. Again no TDS will be deducted on Detaintion Charges.
