TDS on cotractor

16 August 2010 Dear sir,

Is TDS is to be deducted on contractor for loading & unloading contract after 1.10.09? As my client is considering it as a Transportor.

16 August 2010 In my opinion, TDS would be applicable under section 194C as the services in question is not of freight but its of "loading & unloading charges".

In my view, if a transporter, provides services other than carrying goods, then the exemption available in the ambit of transporter under 194C, will not apply.

16 August 2010 Yes, Section 194C will be applicable on contractor for loading & unloading contract. It is different from transporation activities.
