Could you please advice me whether TDS is applicable for the following:

1. Sea Freight (Shown in the Invoice as Conversion of USD into INR)

2. Air Freight (Shown as Above)

3. Ocean Freight (shown as Above)

4. Freight Collection Charges (Shown as Above)

5.CC Fee

6.D.O Charges

7.IGM Filing Charges

21 February 2011 Dear Expert,

Thank you for providing the solution.

One of the Shipping & Logistics Company says that TDS u/s 94C is not applicable for Ocean Freight and says the amount of Ocean Freight will be paid to Liner in Full. How far his justification is correct.

21 February 2011 TDS not applicable on ocean freight and sea freight if it is paid to non residents and if he has exemption certificate u/s 172 of income tax act. Generally Non resident shipping co. have this certificate.
