TDS-Form 16-Not Available in NSDL

On cross verification of TDS Certificates (Form 16), it is noted that few Deductors especially Banks failed to upload the data in NSDL website.
If the Assessing Officer refuses to allow Credit inspite of producing TDS Certificates (Form 16)in original,what course of action could be suggested to the Assessee

Please refer to instruction no. 5/2010 dtd. 21/07/2010.
The assessing officer is duty bound to allow the credit after verification from the deductor's end.
