TDS deduction of Truck operators

03 October 2009 Dear Sir,

We have been informed on thye circular relating to non deduction of TDS upon transporter contractors upon submission of PAn card applicable from 01/10/2009.

This letter is just to confirm whether this notofication holds good upon truck operators. There is no clarification upon whether a truck operator shall be considered a transporter. Kindly clarify.

03 October 2009 Sir , whats a truck operator ? Do u debit truck operating expenses as transportation charges ?

If u debit those charges as transportation and if his bill mention transportation charges, then the amendment will hold good in yr case.I am not aware of any notification issed in this regard. The amendment is made after the enactment of the finance bill 2009

06 October 2009 The exemption from TDS is applicable to "plying, hiring or leasing goods carriages", which may cover truck operator as well.
