and employer deducted less tax of that amount.

now Income tax department demended tax from employer of such less amount.

please help

is it correct

if possible with case law

19 January 2012 Yes income tax department do it. If employer not paid diffrence amount then exp. for that portion will be disallowed. In this case an employee has no reason to worry.
