TDS 194 c and ITR 1

16 March 2011 I am retired but under contract in Gov. Company.
My TDS was deducted under 194C .
But I filed online with ITR1 by entering income in heds "salaries".
I got Demand notice to pay income tax though I was elligible for refund From CPC.
So I have files rectification by revising to heads "income from other sources".
Is tds 194 C applicable to ITR1 or it is only for ITR4 ?

16 March 2011 You are retired. And carrying on contracting business. Its only ITR 4 which is applicable for you

As per your information,you was salary employee and after retirement you start working as Consultancy or contract basis,
then only consultancy requires ITR 4,
abt your demand note, pls confirm on which matter you have 143(1)intimated to pay tax

21 March 2011 AS computed under 143(1),
I have been intimated to pay tax because CPC computed my TDS as 0 instead of that cut by the company under 194C. Hence I was shown to pay tax instead of getting refund.

Does it now mean that I have to file returns as "revised " under ITR4 before March31, 2011?

21 March 2011 No, you don't need to revised its ok
but there is a problem in company tds return.

you have to do just two things
1) ask your company to revised your return without error to get credit of your tds deduction.

2) rectification u/s 154b(2) to rectify the mistakes of not takes credit of your tds deduction.

also check the tds credit from where to know ?
