14 June 2014 Hi, I am parthesh bhatt actually i am doing cs, working in hospital organization. I have one query regarding TDS. In our organization we recruit carpenter on voucher and deduct TDS for the same his voucher amount is around 8000pm. He has no other income. Can he submit any form to organization to avoid TDS process. I heard Form no.13 can he submit If no, than which form he can submit to organization?

14 June 2014 Yes, he can submit application in Form no. 13 to the Income tax officer to give him a certificate for Nil/Lower deduction of TDS.

If Assessing Officer is satisfied that the total income of the recipient justifies the deduction of income-tax at any lower rates or no deduction of income tax, as the case may be, the Assessing Officer shall, on an application made by the assessee in Form No.13, give to him such certificates as may be appropriate.

Where any such certificate is given, the person responsible for paying the income shall, until such certificate is cancelled by the Assessing Officer, deduct income-tax at the rates specified in such certificate or deduct no tax, as the case may be.
