Rate of tariff and the prescribed return for the goods of following description.

It is coming under tariff heading no.1903 0000. The tariff rate is 6% (plus cess). But effective rate is 2%(plus cess) if you are not availing CENVAT benefit. The excise return is Form ER-1.

Dear Rengaraj sir,
Thanks for your reply, the assessee is a new concern formed on 02/2012 and his turnover not crossed even 1.5crores during previous year and for this year upto this date turnover doesnot exceed Rs.1.5crores. whether the assessee need to file the return or pay tax or need to file any declaration.
The assessee registered with Central Excise department and got RC for manufacture of the above said product on 02/2012.
Kindly guide me in this regard.

The excise duty is payable only after reaching 1.5 crores but keep the department informed about the 1st quarter turnover in order to prove that your turnover has not crossed the SSI exemption limit. If needed by the Range Superintendent, you will have to file a declration or show turnover in the return in the exempted column. Pl meet the range people for better guidance.
