St on joint development agreement

A farmer gives development rights of land to builder to construct building. Builder builds building and gives 2 floors in the building to farmer and sells the remaining 8 floors.
so now the query is if the 2 floors given to farmer is construction service or works contract service?

but the owner is farmer only he's just giving development rights for which he's getting flat in return. so ideally it should b works contract no?
