09 August 2010 PLEASE GIVE DEAILS OF SERVICE TAX LIABILITY ON BPO SERVCIES, WHETHER SERVCIE TAX PAID ON EXOPRT OF SERVICE CAN BE REFUNDED. UNDER WHICH HEAD SERVCIE TAX LIABLITY ATTRACTS.

Whether services provide by BPO unit are qualifying as export – assuming your service are qualify as export - there are three ways to claim refund
-Notification 11/ 2005 ST 19 April 2005 (Rebate on service exported)
-Notification 12/2005 ST 19 April 2005 (Rebate of input/input services used in providing output service exported
Rule 5 of the Cenvat credit Rule read with Notification 5/2006 CE- Refund of unutilised Cenvat credit
