28 May 2010 Whether the provisions of Section 274(1)(g) applies on a Private Company or not?
If any person is a director in a Public Company and has defaulted under this section, then whether he will be qualified for being appointed as a director in a private company as well or not?

02 June 2010 A)The provision is applicable to those private companies which are subsidiaries of a public company.

A private company may however through its AOA provides that provision of section 274(1)(g) will apply to it.

B) He can be appointed as a director, provided the private company is not a subsidiary of a public company.
