01 January 2016 OUR CO. IS MANUFACTURING SAUCE & FALL UNDER TARIFF NO. 21039090

IN F.Y. 15-16 WHAT IS THE RATE OF EXCISE DUTY. WHAT IS THE METHOD OF CALCULATING EXCISE DUTY ON MRP PRICE OR ON KG.UNIT.

YOU ARE REQUESTED TO EXPLAIN BY GIVING ONE EXAMPLE.

01 January 2016 Dear Rajkumar
Since you fall under tariff heading 21039090,
Valuation of your product fall under notification 01/2011dt 01/03/2011, excise duty applicable on you is @2% ad-valorem without availing cenvet credit on input and input services.
You do not fall under notification no 49/2008, hence MRP based valuation not applicable.

BUT IN EXCISE NOTIFICATION NO.11/2011 MENTIONED 35% ABATEMENT ON MRP VALUE OF SAUCE ( TARIFF NO.21039090 ) AT PRESENT WE TAKE ABATEMENT 35% & CHARGE EXCISE DUTY 2% .YOU ARE REQUESTED BOTH NOTIFICATION I.E 1/2011 & 11/2011 ARE CONCERN WITH SAUCE IS CORRECT OR NOT .PLEASE GIVE GUIDANCE.
