Sale of imported machinery before obtaining eodc

07 June 2012 Dear Sir,

Please clarify whether machinery imported against EPCG can be sold / transferred without taking EODC but after completion of Export Obligation.

For instance, machinery was imported in year 2004 against EPCG license and its export obligation was fulfilled in 2007 but its EODC was not taken and then sold.

07 June 2012 machinery imported against EPCG can not be sold / Transferable without the Fulfill without the export obligation .

Also Noted that id LICENCE HOLDER fails to fulfill the E.O., he shall pay the Duty of custom Plus Interest prescribed as per Department Of Custom .

also reaad Para 5.14of hand book of procedures vol-1 (2012-13)

Thanks for your reply, please clarify in our case export obligation was fufilled but EODC was not applied and machinery was sold / transferred before taking EODC.

Please tell the implication in said case.
