11 March 2013 Dear Sir,
My Company is a Real Estate Developer Company Constructing Flats in Noida. We are Importing Tiles and UPVC Door Windows from China. We are Paying 4% Additional Duty. We are paying Vat on All Import as per UP Vat Rules.
We want Claim SAD Refund as we will sale our flats in future. Can we claim the said Refund.
Please solve this Query.and provide notification for same

11 March 2013 You can claim. The notification does not say anything about the nature of business. However, you need to follow the procedure lay down in the circulars issued. Notification No. 102/2007 Cutm. dated 14/09/2007

11 March 2013 Dear Hanumantha Reddy Sir,
Thanks for your speedy reply. As per notification we have to issue proper Sale invoice of imported goods.In our case we consume this imported material in our Flats and will sale same in future so how can we claim the sad refund kindly explain.

12 March 2013 No. SAD refund can be claimed only when the imported goods itself is sold as such. It is given to avoid double taxation pertaining to sale of goods.
