Sir we are import milking machinery item and paid additional duty (sad) and we are assemble that part and sold milking machinery in local market

NO YOU CANNOT TAKE SAD REFUND IN SUCH CASES. CENVAT IS ALSO NOT AVAILABLE AS YOUR FINAL PRODUCT IS EXEMPTED FROM EXCISE DUTY.
BUT YOU WILL AGREE THAT YOU ARE ALREADY GETTING MUCH MORE BENEFIT THAN THE SAD,AS YOUR FINAL PRODUCT IS ALREADY EXMEPTED FROM EXCISE DUTY.
