Rules regarding absenteeism

17 June 2013 Sir i have been not going to my Principal office since January as I had some conflict with him regarding some matters. He told me not to come office and later when i told him to give me transfer he is not providing me that also. further he sent me a letter during April month that you are not coming to office since January and i had made you several calls you are not responsing.

After that when my father visited his office he told that he will sign my exam form but don't send him office. He is our relative also but due to some family problems he is doing all this to me.

if he had also sent one letter to institute then i will be informed by institute regarding my absenteeism or what other actions he can take against me??

Plz help me sir.

17 June 2013 1)See, here the issue is some family disturbances he don't want to see you in office..

Generally a learned person may not harm on children due to difference with parents..so no need to fear..depends on nature on ur relative CA,

But if you see he sent a letter to you stating that you are not coming to office

It seems,..we can also understand that he is trying to get some proofs to make you guilty of misconduct during practical training..
.
1)However you better take transfer from him if it not exceeds 1 year as obtaining practical exposure and effective article ship is the back bone of our profession .

2)Convince him for transfer it is recommended don't send father to speak with him..if he is having differences with ur father..it is recommended meet him personally in home/office and make him good..

17 June 2013 I would like to provide you some safe gaurds which will be better for you,

1)Take stipend from him monthly as per ICAI guidelines via cheque, and pay him cash for those cheques..

2)prepare work diary and get it signed from him.

if you can make it available from him as above..he is not entitled to complain on ur behalf..

And above mentioned was compulsory to maintain by every one..as ICAI may asks any time to provide the proof as above..

3)you must approach him and request him..not to punish you for this differences,..request him that you want his training or ask him to provide training any of his friends firm..

He may agree unless he have a great anger on u

17 June 2013 I have completed 2 years of articleship and had not maintained any dairy book with him.. Actually i introduced him with one person for doing share job and he might have done some cash transaction with him which was not known to me from both side.. now he is claiming that my man has done fraud with him and he had incurr a loss of sumthing 15 lacs. Now he is thinking that its all appened becoz of me and doing such things with me..

If he had sent a letter to institute then institute will call me regarding this matter??

17 June 2013 1) i cannot say on whether he complain or not
it depends with him..

2)yes..if he complain any with institute icai will give you a oppurtunity of being heard..
you can respond to what icai will asks
