Here are the answers to your queries about incorporating a new company using your existing DIN and DSC:
1. Which form to fill for incorporating a new company? Use SPICe (INC-32) form for incorporation of a new company.
SPICe is an integrated form that covers:
Name reservation (through RUN or part of SPICe)
Incorporation application
DIN allotment (if needed)
PAN & TAN application
Since you already have DIN and DSC, you can directly file SPICe (INC-32) along with eMoA (INC-33) and eAoA (INC-34).
2. Can I choose an abbreviated name like "ACX Tradex Pvt. Ltd."? Yes, you can choose an abbreviated or coined name.
However, the name should not be identical or too similar to an existing company’s name.
The name should be meaningful and should not violate any naming guidelines under the Companies Act.
You need to explain the significance of the key or coined word in the proposed name in the relevant column.
3. What to write in the two columns in the name application form? "Significance of key or coined word in the proposed name": Explain the meaning or reason for using any unusual or coined word in the company name. For example, "ACX" stands for "Advanced Corporate Exchange" (or your own explanation).
"State the name of vernacular language(s) if used in the proposed name": If your company name includes words from any Indian regional language(s), mention the name(s) of those language(s) here. If the name is fully in English, write "Not Applicable" or "N.A."
4. Do I need a practicing professional's number for filing INC-1 or name application? For INC-1 (name reservation), you do not need a practicing professional's (CA/CS/CMA) membership number if you are filing yourself.
However, if a professional is filing on your behalf, their membership number is required.
For SPICe (INC-32), the form requires DSC of the directors and the applicant, but no mandatory professional number unless filed through a professional.
