08 July 2010 A person from India has gone to study abroad.During the previous year 2009-2010,he was in India for 119 days.Can he have the NRI status? Are there any other conditions for the NRI status ?

09 July 2010 If your question from the point of view of income tax for residential status then he will be Resident for India for P.Y. 2009-10.

Actual, according to sec. 6(6) Exception is applicable only if the Indian citizen leaves india for Employment purpose.

Here, he is leaving india for study purpose thereofore sec 6(6) is not applicable on him
