Regarding termination of articles

25 April 2014 Dear Sir/ Madam,
I took termination on 15/03/2014, My period of 1 year of articles will be completed on 24/03/2014. I had sent Form 109 along with ID card of previous employer on 25/04/2014. What will be the provisions apply to me regarding delay of submitting of form no. 109.

25 April 2014 For delay in submission of form 109 the ICAI shall levy penalty of Rs.100. Actually the liability to submission of form 103 & 109 is held with the employers, so actually payment of penalty if any is also the responsibility of the employer, but for maximum cases students are bearing this penalty liability.

26 April 2014 Sir, thanking you for your advise. I am scared about termination of articles as i had took termination in 11 th month of my 1st year articles. will any provisions applies to me... kindly reply me .
Note: not searched for articles at new employer

26 April 2014 You are in first year of articleship training at the time of taking of termination so any provisions related to articleship transfer conditions not applicable to you. So don't worry. Joining at other employer or not is irrelevant for this.

26 April 2014 Yes, but even not addressed then may not be problem,because of later ICAI request you about that. Yes, form 109 should be send/submit for taking termination.
