If we have paid by mistake penalty under section 11AC more what is actaully being paid and order confirmed the same paid amount. Can we have any remedy provision under excise or other law for getting back the excess paid amount as penalty.

If the penalty amount has been confirmed by the adjudication order, then only remedy is invokation of appellate jurisdiction. Means file appeal to the higher forum.
