Refund for NRI

This query is : Resolved

Quick Summary
An NRI filed their tax return seeking a refund, but it failed because their PAN was marked as inoperative. The issue arose because PAN-Aadhaar linking is mandatory for residents, but NRIs are exempt. To resolve this, the NRI needs to update their residential status to 'Non-Resident' on the e-filing portal, providing supporting documents. If the PAN remains inoperative, a grievance can be submitted requesting reactivation. Following these steps successfully led to the PAN becoming operative and the refund being credited.

12 November 2025 ITR 2 for NRI for AY 25-26 was filed on 14.08.2025 asking for refund.
Refund has failed due to PAN Inoperative
Department is asking for PAN And Aadhar
Since the assessee is NRI he does not have Aadhar number ?
Refund reissue request also cannot be raised since PAN is operative

What steps need to be taken so that refund is credited to his bank ?

12 November 2025 - PAN-Aadhaar linking is mandatory only for residents eligible for Aadhaar.
- NRIs are exempt under Rule 114AAA read with Section 139AA of the Income Tax Act.
- The PAN may have been marked inoperative because the system assumes the assessee is a resident.
- Update Residential Status to “Non-Resident”.
- Upload supporting documents (e.g., passport with foreign visa, OCI/PIO card, overseas address proof).

- If PAN remains inoperative after updating status:
- Go to e-Filing Portal → Grievances → Submit Request.
- Select “PAN marked inoperative despite NRI status”.
- Attach proof of NRI status and request reactivation.
