As per S.2(13) of the Income Tax Act, 1961, unless the context otherwise requires, the term “business” includes any trade, commerce or manufacture or any adventure or concern in the nature of trade, commerce or manufacture.
If your only income is the commission income, it will be a business income and you need to file ITR.
Addnl point on Service Tax - Also, the government in the Budget has exempted service tax levied on agents earning less than Rs 10 lakh annually.
