09 December 2011 Sir main ek company me canteen me labour provide karta hoon jiska ek Contract bhi bana hai. Canteen me Material company provide karti hai main labour provide karta ho jo sab kuch banati hai. Canteen se mujhe Rs.80000 p.m milte hai jisme main 11 workers ko salary bhi deta hoon. Total salary Rs. 7000 x 5 + 5000x 6 = Rs.65000 or baaki mere pass bachta hai. Company ke MD ka kehna hai ki tum Rs. 80000 ko 6 workers k naam pe le lo jis se aap ka or hamara Tax bach jaaega. Aap bataae ki mujhe kya karna chaahiye. Or ye be bataye ki meri tax liability kya hogi. Mere pass PAN No. b nahi hai, agar company koi tax kaategi to kitna kaategi or main kaise use kam kar sakta hoon. Agar main Rs. 80000 ko 6 workers k naam pe loon to mere workers mujh se ALAG ho jaaege. Please ye bhi bataye ki kya mujhe kisi TAX Registration bhi karana hoga jaise VAT TAX, SERVICE TAX, ESI,PF.

09 December 2011 Since there is a contract so the company have to deduct tax under 194C i.e TDS TO DEDUCTED FOR THE CONTRACTORS .And since you dont have a PAN apply for it and provide pan number to the company otherwise the company will deduct tds @20%. If u provide PAN company will deduct only 1% tds on you .And there will be no saving of tax according to my view
