This discussion addresses the tax treatment of capital losses incurred on Fixed Deposits (FDs) from Plethico, Elder, Helios, and potentially DHFL, as well as Non-Convertible Debentures (NCDs) from DHFL and SREI. The user inquired about offsetting these long-term capital losses against other long-term capital gains and carrying them forward for up to eight years, as well as the necessary proof for claims. The response clarifies that only a partial settlement amount, not a 'nil' settlement, can be claimed as a capital loss, though this is under consideration by the government.

Lost the whole amount of FDs from Plethico, Elder, Helios and may lose partly from DHFL FD & DHFL & SREI NCDs. Can we offset this long term capital loss against any LTCG from other asset classes and carry forward for eight years? Do we need to submit any proof to claim this? Thanks

If you had received any paltry amount as settlement, then you can claim the remaining amount as loss; but 'nil' amount is not considered for transfer and as such, as of today, it is not considered for capital loss. Though the same has been represented to Government for the consideration.
