Commissioner or Joint COmmissioner of Income Tax whether Penalty waiver order can be issued by them or it will be noted in the docket sheet and file will be closed please clarify.

30 May 2012 Waiving of penalty is the discretion of the concerned authority where it does not require any certificate.
A simple note is written done in the sheet for the closer of the case which remains with him and got signed by the concerned person or by the legal representative.
