When penalty is dropped by an Assistant
Commissioner or Joint COmmissioner of Income Tax whether Penalty waiver order can be issued by them or it will be noted in the docket sheet and file will be closed please clarify.

Waiving of penalty is the discretion of the concerned authority where it does not require any certificate.
