23 November 2009 I have filed Form-8 but we have not made payment of challan.
so how i get fresh challan because orignal challan expires

24 November 2009 You have to file Form 8 again. However, mere filing of Form 8 will not serve the pupose as it needs to be registered with ROC.

As you have mentioned that original challan expires, you have to go for Condonation of delay as follows;

1. If delay up to 30days.

Make application in Letter (as no form is prescribed)to the Registrar giving details for the delay. If Company satisfies the Registrar that the delay was caused due to genuine reasons. the registrar can condone delay up to 30 days. (Section 125(1))

2. If delay beyond 60 days.

The Registrar can't condone a delay beyond 60 days, unless there is an order issued by the Company Law Board condoning the delay. The Company Law Board may condone delay beyond 60 days on a petition being made to it under section 141 for condonation of delay
