14 March 2011 hi i have file the ITR 5 of the trust for Fin year 2006-07 & 2007-08 relevant to asst year 2007-08 & 2008-09 but i am unable to upload the return for the above year as its showing belated return. manual filing also they are not accepting and query sent to cpc not answering
kindly help me out regard hw to make online filing of this belated return

14 March 2011 Hi,

There are couple of issues

1.If its a Trust you need to fill ITR-7 for filing the IT Return not ITR-5.

2.For the years 2006-07 & 2007-08 the time for filing the returns is already over, so you can not file those returns for time being.
if you receive a notice for non filing from IT department then you need to file.

Last thing there's no option for filing trust returns online, compulsory must do it manually.

14 March 2011 you can apply for filing return under section 119 (2) (b) of the Income Tax Act, i.e. condonation to delay in filing of return. However, you have to file application in prescribed format to AO and once AO grants you the delay, you can file your return. For more reference see section 119 (2) (b) of the Income Tax Act.

14 March 2011 Well for filing return of a trust , you need to submit ITR-7 and it cant be filed on line it will be submitted manually.

as on now u can file for Ass year 2009-10 and 2010-11 not below these A.Y.
