25 October 2016 Can a Practicing Company Secretary certify the annual return i.e. MGT-7 of a company where he was a Whole time company secretary one year ago?

25 October 2016 AS PER SECTION 92 OF THE COMPANIES ACT 2013, ANNUAL RETURN , I.E FORM MGT 7 SHALL BE SIGNED BY WHOLETIME COMPANY SECRETARY OF THE COMPANY IF ANY ON DATE OF FILING MGT 7

26 October 2016 According to section 92 of the Companies Act 2013, Annual return of the Listed Company and the Company with the paid up share capital of 10 crore rupee or more or turnover of 50crore rupee or more shall be certify by PCS in form MGT 8.
But if as on current date if there is no whole time CS in the Company Annual return in form MGT 7 shall also be signed by PCS
