Is there any scenario where an individual has to pay a surcharge but can't avail of the marginal relief?

No, unless where the relief is not applicable, e.g. when total tax liability is Rs. 51,95,896 or more (but less than 1 Cr.) marginal relief is nil. similarly under each slab....
