Machine sale which purchased under epcg eo

13 December 2013 Dear Sir,

I want to know that a Private Limited Company want to sale a complete unit in which machine was purchased under EPCG Scheme EO in the year 2011. Till date there is no any export made.Is it possible to sale the unit with Export Obligation?

14 December 2013 Please refer para 2(2) of the Notification No. 103 /2009-CUSTOMS dated 11 September, 2009 which enumerates that the goods imported shall not be disposed of or transferred by sale or lease or any other manner till export obligation is completed. In your case, export obligation has been fulfilled therefore, you may sell the capital goods.
