21 October 2008 A company is making payment to B company for shred power evacuation facility. Whether A company is required to deduct TDS. If yes than whether u/s. 194J or 194C

21 October 2008 A company has windmill.It doesnot have the transmission lines. It uses the transmission lines of Company B. In this regard payment s are made and service tax is also applicable. It is SHARED POWER EVACUARTION. It was wrongly typed as shred

21 October 2008 It depends on the agreement entered into.if it is for rent of machinery(i.e,it is used for fixed period.of time) then 194I,or else 194C.

21 October 2008 What I understand is that A company is using only transmission lines of B company, in this case I dont think it involves technical assisstance.If B company would have given their expertise in the use of transmission lines or running of windmill, then the question would have come.
