04 October 2011 Dear Experts,

For AY 2009-10 Firm has not filed its IT Return on time, but they have to claim Refund of Rs. 1 Lacs on account of TDS Deduction, so can we file Return now, & if yes then can we claim Refund for AY 2009-10 & What panelty ITO may impose for late filing of return.

Pls. reply urgently.

04 October 2011 The time limit for filing belated return for AY 2009-10 was 31.03.2011.

Since, the time limit has expired, the return has become time barred and cannot be filed.

04 October 2011 DUE DATE FOR FILING RETURN IS OVER. EVENIF BELATED RETURN 139(4)DUE DATE IS ALSO OVER.

I THINK U HAVE TO APPLY TO A.O.IN WRITING SPECIFYING THE REASONS FOR NOT FILING RETURN. IF A.O. SATISFIES ABOUT REASONS HE MAY REFUND THE TAX PROVIDED INTEREST FOR LATE FILING IS PAID.

Pls suggest whether late return can be filed online, or we have to file it manually.

if it can be filed online then do we have to take prior permission of AO or not.

Pls. reply urgently.

04 October 2011 Generally late returns can be filed online. But, we cannot file returns online related to AY 2009-10 because of the due date for filing the same is 31st March, 2011.

Manually we need to file those returns.

05 October 2011 First take prior permission to AO.
After taking prior permission of AO
you can file it online U/s 142(1),U/S 148 or U/s 153A, 153C.
