01 April 2013 Sir,
I am salaried person , My Total Income from salary & Other income is Rs 223012.00 & tax amount is Rs 970.00 but TDS deduct from salary is Rs 1000/- As per 26 AS for the A/Y 2012-13.
I have filed ITR -1 on 31/3/2013 but due to Internet problem My return upload on 31/3/2013 at 12.05 am so that sytem generate PDF file ITR V & Date mention 01/04/2013.
In my case for filing ITR 1 is mandatory or not. I want to know Can I penalized by I Tax deptt.

01 April 2013 According to the income tax act an employee who has salary income and sufficient salary deducted by the employer filing of IT return is not compulsory at the option of employee can file their return. So in your case you have sufficient TDS so no need to file return of income as well as to file your A.Y 2012-13 due date u/s 139(4) available upto 31-3-2014. As well as you have not any tax payment liability i.e you have TDS so penlaty will not be leavy. So don't worry about that you send your ITR-V acknowledgement to the CPC for completion of your process.
