i need to file the return for the FY 2008 to 2009, can u please tell me the procedure on how to file it now, and the amt of penalty if any i have to pay. kindly note that i dont have any dues to be paid.

U cannot file the return of the FY 2008-09 now.

Now you cann't file the return of Income for the F.Y.2008-09 i.e A.Y.2009-10 its time to file return of income is upto 31-3-2011 only. It's over and now you cann't file and eventhough you filed it now the department doesn't accept and it is invalid return. In case if you received notice u/s 142(1) regarding "file return of income for such year from the department" then only you will file it and it is valid otherwise not.
