but 31.3.2013 is last date of FY 2010-11 filling . penalty is applicable..?

01 April 2013 Check if tds is deducted or not whether Advance tax is paid.. Generally they dont charge penalty but some times you may get notice to pay penalty..
I filed many times belatedly til now i did not get any penalty notice..

01 April 2013 Then no problem file the return and claim refund. If tax audit/ company itr case then you need to feel all these pressure.
If it is individual return you can file and claim refund

one more question.
one of my client is not fill last four year IT return from AY 2009-10 to AY 2012-13.

now, he want to fill for AY 2009-10 & AY 2010-11 refund.

can it possible...?

01 April 2013 No i think. U can try manual filing at the Income tax office if they accept it is quite good..

01 April 2013 FIRST OF ALL, I HAVEEEEE TO SAY, THAT I AM REALLY SOOOOOOOOOOOOOOOOOO DISAPPOINTED FOR THE IMMATURE /WORTHLESS /BASELESS PERFORMANCE OF MR . SUNIL , & I ADVISE YOU, MR. SUNIL, THAT " DON'T YOU EVER TRY TO GIVE ANY KIND OF SUCH IMMATURE/WEAK/WRONG/BASELESS TYPE OF ADVISE ".
1) FIRST QUERY :- BECAUSE FOR F.Y 10-11 --> IT RETURN CAN BE FILED WITH IN 31/03/2012 ( WITHOUT PENALTY OF RS 5000/= )& AFTER WHICH A PENALTY SHOULD BE IMPOSED OF RS 5000/= IF FILED UPTO 31/03/2013 , BUT PENALTY SUBJECT TO THE DISCRETION OF THE ASSESSING OFFICER & AFTER 31/03/2013 , YOU CAN'T FILE UNDER ANY CIRCUMSTANCES , BECAUSE THEN, IT SHOULD BE TREATED AS AN ' INVALID ' RETURN.
2) SECOND QUERY:- FOR F.Y 2011-2012 , YES , YOU CAN FILE EVEN AFTER 31/03/2013 & UPTO 31/03/2014 , BUT A PENALTY SHOULD BE IMPOSED OF RS 5000/=.
3) THIRD/LAST QUERY :- I AM REALLY SORRY TO SAY, THAT TIME ALREADY EXPIRED FOR BOTH THE A.Y 2009-2010( EXPIRED ON 31/03/2011) & 2010-2011 ( EXPIRED ON 31/03/2012 ).
& AT LAST I WANT TO GIVE AN ADVISE TO MR. SUNIL THAT, whenever you are answering any vital income tax matters " DON'T YOU EVER TRY TO USE THESE KIND OF BASELESS WORDS LIKE > " i think / you think/ you can try / i can try & so on" , BECAUSE ," RULES ARE RULES & NO ONE CAN DENY THIS & DEFINITELY , WE ARE NOT ABOVE THE RULES "...........
