Can ITC claim if gst paid on employee health insurance premium ?(which is paid by employer)

The Advance Ruling Authority (ARA) has clarified that if an employer is obligated by law to insure its employees, then ITC can be claimed. However, if there is no legal requirement, the employer cannot claim ITC on health insurance premiums.
