03 August 2013 Is it necessary to inform CA that an article is seeking transfer for Industrial training ??? Or can it work if he just says that he is shifting to a firm outside the city??

03 August 2013 no u need to file form 109 for transfer and it should be duly signed by the existing CA.

But I had read that you have to give 3 months notice for industrial training to your CA.. Hence, I want to know whether any problem would occur if I say I am going out of city but do the industrial training inside the city??

03 August 2013 no, you will not face any problem but your principle should sign form 109.

03 August 2013 but if you are in your 2nd or 3rd year of articleship then first u need to write a letter to icai seeking permission for transfer and only when they permit u in writing then only u can file a valid form 109.

if you are in first year then directly file form 109 to icai.

Note industrial training can be done max for 9 months - 12 months.

03 August 2013 there is no time limit as such you can write now also or later when u desire.

03 August 2013 Ok.. And I have my college timings written in my form as 7 30 to 10 30. Will it have any affect if the new companys timings are from 10 am.??

03 August 2013 yes.....icai will not permit if you if timmings are after 10.00 am so it is advisable not to write before 10.00am else no permission will be given to you.

03 August 2013 Ok..And timings of the company depends on what I wtite on the form right?? Just needs approval of the authority signatory of the company for the same??? Or will the institute indirectly call to find out the normal working hours of the company?

03 August 2013 for industrial training you can do only from company which is reg with icai as icai has all the details about the company.

do not lie in form 109 wlse you will be in serious trouble.

03 August 2013 ya but if you write timmings which are different from icai records for that company then they will take action against you for providing wrong details.

03 August 2013 Alright..And can I enquire from somewhere regarding the timings as kept by ICAI? Will they gimme the details? This is coz I have to pay my 3rd year fees soon..so if timings arent setting then I shall shift to correspondence.
