Income u/s 139 or 143...Urgent Sir!!!

23 August 2010 Dear Experts,
Very urgent sir..
In our firm we have filed tax return for an assessee for the all the years as per sec.139.
For the a.y.05-06 & 06 -07 first refund order u/s 143(1) has been received..and there were no difference between what we filed and the order received u/s 143(1).
Then the A.O. issued the notice u/s 143(2) - for scrutiny assessment.
The order has been passed u/s 143(3) which was different from the return we were originally filed.
1)My doubt is for the respective assessment years for which scrutiny has been taken whether the loss or income as intimated u/s 143(1) i should take or
the loss or income as intimated u/s 143(3) i should take?

23 August 2010 YOU SHOULD TAKE ACCORDING TO THE ASSESSMENT ORDER U/S 143(3) .143(1) IS NOT AN ASSESSMENT ORDER. IT IS AN INTIMATION.
IF YOU ARE NOT OPTING FOR APPEAL

24 August 2010 Please take as per 143(3).

Further please confirm whether you have gone into appeal or not, if yes then you should claim as per the intimation
